How CPS Separated My Family Based on Fabricated Evidence
James Mitchell
March 15, 2024
James Mitchell was living the American dream—a stable job, two beautiful children, and an ex-wife with whom he'd maintained a civil relationship. Then, in 2020, everything changed in a single afternoon.
Without warning, CPS arrived at his home with police officers and took his two children, ages 7 and 9. The basis? A phone call from his ex-wife alleging he had "shouted at the children." No investigation was conducted. No evidence was examined. No interview with James himself took place before the removal.
"I was devastated," James recalls. "My kids were crying, asking what they did wrong. I had to tell them it wasn't their fault—when I had no idea what was happening myself."
What followed was a nightmare of bureaucratic indifference and judicial negligence. The court ignored James's requests for immediate custody restoration. CPS caseworkers failed to investigate the ex-wife's motive (a custody dispute over child support increases). Court-appointed evaluators—who spent minimal time with James—recommended supervised visitation for a man with no criminal history and no evidence of wrongdoing.
James spent $47,000 on legal fees. He fought through three court hearings. He completed parenting classes, psychological evaluations, and drug tests (all negative). He documented his care for his children through years of school records, teacher recommendations, and pediatrician notes.
After 34 months—nearly three years—a different judge finally reviewed the evidence and ordered the children restored to James's custody. The original allegations were never substantiated. No apology was offered. No accountability was assigned.
"My kids were taken from me during their most important developmental years," James says. "The system that was supposed to protect them destroyed our family. And no one in that system faced any consequence for what they did."
Today, James works with families' rights advocacy groups, helping other parents navigate the same broken system. His children are healing, but the emotional scars remain.
"This can happen to anyone," he warns. "If you're going through this, know that you're not alone. Document everything. Fight with everything you have. And never stop believing in your right to be a parent to your own children."
